In 2018, Utah voters chose to eliminate congressional district gerrymandering. The GOP dominated legislature has fought against this ever since - to include attacking courts for carrying out the law.
The Republican appointed Utah Supreme Court, in an unanimous ruling, struck down the legislature's attempt to "repeal" the initiative citing the authority given to the people by the Utah constitution. The court stated "We hold that the people’s right to alter or reform the government through an initiative is constitutionally protected from government infringement, including legislative amendment, repeal, or replacement of the initiative in a manner that impairs the reform enacted by the people." Amen.
As of December 31, 2025, the legislature has not appealed Judge Diana Gibson's ruling - even though Judge Gibson pointed out they could have appealed both her 25 August and 10 November rulings. Instead GOP leaders, acting in bad faith, have called the Republican appointed judge an activist. The dishonesty of that position, however, is revealed by GOP Speaker of the House Schultz acknowledging their weak case in appeal by stating "Based off of the Supreme Court’s ruling of last summer, I think we probably know what the Supreme Court’s going to say there.” (Deseret News, 29 Dec 25, "Utah Legislature to appeal redistricting case to Utah Supreme Court next week; Why the long wait?")
I will fight against any effort by the legislature to overturn Proposition 4.
